What this is
Upperkick watches one screen you choose and listens to what your computer plays, and talks to you about it out loud while you play. It is software, and the thing talking to you is a language model.
You must be 18 or over
No exceptions, and it is asked before anything else happens. The product is built to be talked to late at night by somebody on their own, which is precisely why it is not for children.
She is an AI, and she gets things wrong
You are not talking to a person. She has no memory of you beyond a short note — kept on your own computer, and, if you have a licence key, held with your account in a sealed copy only your key can open. She has no life outside the session and no way of knowing anything she was not shown.
Do not rely on anything she says without checking it. She will state things about a game, a mission, a mechanic or the world with complete confidence and be wrong. That is a property of the technology and not a fault that will be fixed.
She is not a doctor, a therapist, a lawyer or an adviser of any kind, and nothing she says is advice. If something in your life is wrong, she is told to say so plainly and to point you towards a person — because she is not one.
What you may not use it for
The models behind this come from Anthropic, Cartesia and Groq, and their rules apply to you as they apply to us. In plain terms, do not use Upperkick to:
- Produce sexual content, or anything involving minors
- Harass, impersonate, deceive or threaten anybody
- Break the law, or the rules of the games and services you are playing on
- Work around the safeguards built into it
Showing her a screen is showing it to those services. Be careful what you put in front of her — a document, a message from somebody else, a password — the same way you would be careful about what you share on a stream.
Other people on your screen
In an online game, other people appear on your screen and in your sound. They have not agreed to any of this.
Upperkick is built not to remember them, and you can stop it hearing your computer at any time. The responsibility for what you choose to show it, particularly a voice call with people who do not know it is running, is yours. Where you are, the law may require you to tell them.
The free hour
The first hour of play costs nothing and asks for no card. It is an hour of model usage rather than a period of days, so it waits until you use it. It is given once per installation, and we may stop offering it or change what it includes.
Subscription
A subscription comes with a sign-in key. The key is the account: anybody holding it can use it, so treat it as you would a password.
It is also the only thing that opens the sealed copy of her note. We hold a fingerprint of your key rather than the key, so if you lose it we cannot give it back and cannot recover that note — keep it somewhere you will find it again.
Each account has a limit on model usage for the month you have paid for, shown in the app as you go. She warns you as it runs low and stops when it is spent; it starts again when your next payment goes through, on your own renewal date rather than on the first of the month. The limit is on the cost of the models rather than on hours, because an hour of a quiet game and an hour of a loud one are not the same thing.
Paddle is the merchant of record. Payment is taken by Paddle on their own page, and for that purchase Paddle is the seller: they charge you, they handle the tax where you live, and their terms cover the transaction itself. We never see or hold a card.
Cancel whenever you like, from the billing page in settings, and it runs to the end of the period you paid for.
A part-used month is not refunded as a rule — that is what the free hour is for, so you can decide before paying. But if something went wrong, write to us and we will refund it. And where the law where you live gives you a right to cancel a purchase, you have it: Paddle is the seller and handles those requests, alongside anything you ask us directly.
We can withdraw a key for breaking these terms, and will say why.
No promises about it working
It is provided as it is. It will have faults, services it depends on will go down, and she will sometimes say nothing when you wanted her to speak.
Nothing here limits liability for death, personal injury, or anything else that cannot lawfully be limited. Beyond that, and to the extent the law allows, our liability is limited to what you paid in the twelve months before the claim.
Changes
If these change in a way that matters, the date at the top of this page changes with them. Carrying on using Upperkick after that is how you accept the change; if you would rather not, cancel.
Law
These terms are governed by the laws of Israel, and the competent courts of Israel have jurisdiction.
If you are a consumer, that does not take anything away from you. The mandatory consumer protections of the country you live in still apply, and you can bring a claim in your own country's courts. Nothing written here overrides them, and no term of ours is meant to.
Your purchase itself is a separate matter: Paddle is the seller, and their terms govern the transaction.
